Our Qualifications In Regard To Your DUI or DWI Case
We are defense lawyers that takes the time to learn and improve our craft by obtaining all of the available training in our field. We have taken classes and learned from experts around the county to become trained in the methods used by law enforcement to prosecute our clients.
We have completed training for the Dräger Alcotest®, which is the equipment used for the breathalyzer test at police stations across New Jersey. This knowledge helps us to potentially find weaknesses with the Alcotest® evidence that may be used against you in court. We can review the Alcotest® evidence for flaws and may even be able to have it withheld from legal proceedings which will improve the defense against your pending drunk driving charges. Founding partner, Carmine R. Villani has been trained by Draeger, the manufacturer, on both alcotest insturments used in NJ namely, the Alcotest 7110 which has been in use since early 2009 and the Alcotest 9510 which was first introduced in Monmouth County in late 2022. Mr. Villani is among a small group of DWI and DUI defense lawyers that took the time and allocated the resources to participate in the program to train defense attorneys on how to calibrate and operate the instrument. This is training similar to that provided to the state and local police officers who administer the breath tests to our clients.
To better defend your legal rights, we have been certified in the standardized field sobriety tests that local New Jersey police use. This extra knowledge helps our legal team find flaws in the police stop and observational evidence recorded against you. With our training, we can better defend you against it in court and may even be able to have some evidence excluded from your DWI trial. With our experience and field sobriety training, we may be able to demonstrate that the police did not correctly administer these standardized field sobriety tests and further strengthen your case.
Our attorneys have been professionally trained to properly address and evaluate driving while intoxicated (DWI) cases when the evidence is based off of a drug recognition expert (DRE) evaluation. With DRE arrests increasing in frequency throughout the state of New Jersey, it is of upmost importance for you to find a lawyer that has the most up-to-date knowledge and experience with current DRE procedures to efficiently handle your case by challenging such evidence. DRE training focuses on educating attorneys regarding the proper vital sign and eye exams conducted by DRE officers, including the horizontal gaze nystagmus (HGN), vertical nystagmus test (VGN), and the pupil's reaction to light.
We understand what the local prosecutor needs to do to prove their case and likewise what it will take to defend against the states claims. As a former municipal prosecutor, Mr. Villani was also trained on the Breathalizer which was used prior to 2009 in all New Jersey towns. the Breathalizer was in use for nearly 30 years prior to the new alcotest machines being introduced. Having experience in both prosecution and defense gives us a better perspective and helps us to better represent and defend the right of our clients.
